Please read these Terms of Service carefully before using the Vibneo website or purchasing a product.
1. OVERVIEW
This website is operated by Vibneo, a brand operated by TANK MACHINERY CO., LIMITED.
Throughout these Terms of Service, the terms "Vibneo," "we," "us," and "our" refer to TANK MACHINERY CO., LIMITED and the Vibneo brand.
By visiting the website, purchasing a product, submitting information, or using any available feature, you engage in our "Service" and agree to these Terms of Service. These Terms apply to website visitors, customers, and other users of the Service.
If you do not agree to these Terms, you should not use the Service.
2. ELIGIBILITY AND ONLINE STORE TERMS
By agreeing to these Terms, you confirm that you have the legal capacity to enter into a binding agreement or that you are using the Service with the permission of a legally responsible parent or guardian.
You may not use the website or products for an unlawful or unauthorized purpose. You must not transmit viruses, malicious code, automated attacks, or other material that may damage the website or interfere with the Service.
3. GENERAL CONDITIONS
We reserve the right to refuse or cancel service or orders where reasonably necessary, including in cases involving suspected fraud, unauthorized payment activity, abuse, unlawful use, product misuse, unauthorized resale activity, incorrect pricing or inventory information, or violation of these Terms. Any exercise of these rights remains subject to applicable law.
You may not reproduce, duplicate, copy, sell, resell, scrape, exploit, or commercially use any part of the Service without prior written permission.
4. WEBSITE INFORMATION
We make reasonable efforts to keep website information accurate and current. However, the website may occasionally contain typographical errors, inaccuracies, omissions, outdated information, pricing errors, inventory errors, or technical errors.
We may correct information, update content, or cancel an affected order where permitted by law. Website information should be considered together with the applicable product page, product instructions, warnings, and policies.
5. PRODUCTS AND SERVICES
Certain products may be available exclusively online and may be offered in limited quantities.
Vibneo may offer products across multiple categories, including everyday technology, travel, automotive, outdoor, home, and personal lifestyle products.
We make reasonable efforts to display product descriptions, specifications, dimensions, compatibility information, included items, materials, and colors accurately. Screen settings, lighting, production batches, packaging updates, supplier updates, and manufacturing tolerances may result in minor variations.
Any change should not materially reduce the product's advertised function or value.
6. PRODUCT INFORMATION AND COMPATIBILITY
Customers are responsible for reviewing the complete product page, specifications, compatibility requirements, dimensions, included items, warnings, and instructions before ordering and using a product.
Compatibility may depend on a phone, device, operating system, vehicle, model year, voltage, port, connector, charging standard, app, account, software version, physical dimensions, mounting surface, regional version, or third-party service.
Unless expressly stated, a product is not guaranteed to work with every device, vehicle, accessory, system, application, or operating environment.
Where product-specific information differs from these general Terms, the product-specific information applies to that product, subject to applicable law.
7. PRICES AND AVAILABILITY
Product prices, promotional offers, shipping rates, and availability may change without notice.
A product appearing on the website is not guaranteed to remain available. We may limit product quantities per person, household, payment method, address, or order.
Where an order is affected by a material pricing, payment, inventory, product-listing, or promotional error, we may contact the customer, correct the order, or cancel and refund the affected transaction where permitted by law.
8. ORDERS AND PAYMENT
Submitting an order is an offer to purchase the selected products. An automated order-confirmation message acknowledges receipt of the order but does not necessarily represent final acceptance.
We may review orders for payment authorization, fraud prevention, inventory availability, shipping restrictions, product restrictions, or compliance with these Terms.
Customers agree to provide current, complete, and accurate billing, payment, contact, shipping, and account information.
Payment is processed through third-party payment providers. If an order is cancelled after payment has been collected, an appropriate refund will be issued to the original payment method.
9. SHIPPING AND DELIVERY
Shipping, processing, tracking, customs, address requirements, lost-package procedures, and delivery estimates are governed by our Shipping Policy.
Delivery dates are estimates rather than guaranteed dates. Delays may occur because of customs, carriers, weather, security inspections, local delivery restrictions, incorrect addresses, public holidays, product handling requirements, or circumstances outside Vibneo's reasonable control.
Nothing in these Terms limits mandatory rights concerning delivery, risk, cancellation, or refunds.
10. ORDER CHANGES AND CANCELLATIONS
We begin processing orders promptly after payment is confirmed. Customers should contact support@vibneo.com as soon as possible when requesting an order or address change.
We cannot guarantee a change or cancellation after processing, fulfillment, or dispatch has started. Nothing in this section limits any mandatory cancellation or withdrawal right available under applicable law.
11. RETURNS, REFUNDS, AND WARRANTY
Returns, refunds, damaged-item claims, replacements, and warranty claims are governed by our Refund & Return Policy.
Vibneo provides a voluntary 90-day return period for eligible unopened and unused products. Customers are responsible for voluntary return shipping costs unless the product arrived damaged, defective, or incorrect, Vibneo agrees otherwise, or applicable law requires otherwise.
Unless a product page states a different period or expressly states otherwise, eligible products purchased directly from Vibneo include a voluntary 90-day limited replacement warranty covering qualifying manufacturing defects and functional failures during normal and intended use.
The voluntary warranty is subject to the exclusions and claim requirements stated in the applicable policy, normally provides replacement as the warranty remedy, and is provided in addition to mandatory consumer rights.
12. PRODUCT SETUP, INSTALLATION, AND INTENDED USE
Customers must follow the product page, instructions, warnings, and manufacturer guidance when setting up, installing, mounting, charging, connecting, wearing, operating, cleaning, storing, or maintaining a product.
A product must be used only for its intended and lawful purpose. Customers are responsible for selecting a safe and suitable installation or operating location and for confirming that installation does not damage property, interfere with equipment, or create a hazard.
Where professional installation, adult supervision, safety equipment, or technical knowledge is recommended, the customer is responsible for following that recommendation.
13. CONNECTED FEATURES AND THIRD-PARTY SERVICES
Some products may rely partly or entirely on services, software, networks, applications, maps, accounts, mobile devices, vehicle systems, or platforms operated by third parties.
Vibneo does not control third-party availability, coverage, accuracy, account requirements, security procedures, regional availability, software updates, policy changes, feature changes, interruptions, restrictions, or discontinuation.
Use of a third-party service is also subject to that provider's own terms, privacy policy, account rules, and device requirements. A third-party provider may change, restrict, suspend, or discontinue features without notice to Vibneo.
14. PRODUCT PERFORMANCE AND LIMITATIONS
Advertised performance figures may describe maximum, approximate, typical, or test-condition results rather than guaranteed results for every customer.
Actual performance may vary because of user setup, environment, weather, lighting, visibility, distance, signal conditions, network coverage, device capability, vehicle design, software, alignment, temperature, battery level, mounting position, accessories, and normal manufacturing tolerances.
Products involving tracking, navigation, display, optics, measurement, charging, stabilization, or connected functions are intended as convenience products unless the product page expressly states otherwise.
No Vibneo product should be relied upon as an emergency, medical, life-safety, law-enforcement, professional navigation, or other safety-critical device unless the product page expressly states that it is certified for that purpose.
15. POWER, BATTERIES, CHARGING, AND ELECTRICAL USE
Products must be used only with power adapters, cables, batteries, chargers, voltages, ports, and electrical systems that meet the requirements shown on the product page or in the instructions.
Using an underpowered, overpowered, damaged, uncertified, incorrectly wired, or incompatible accessory or electrical source may reduce performance, prevent operation, damage the product or connected equipment, or create a safety risk.
Advertised charging wattage, battery life, operating time, or power output does not guarantee that every product, device, or operating setup will achieve the maximum figure.
Rechargeable battery capacity normally decreases over time and with use. Customers must not puncture, crush, expose to fire or extreme heat, short-circuit, or improperly dispose of batteries.
16. VEHICLES, MOUNTING, OUTDOOR USE, AND PRODUCT CARE
A product used in or around a vehicle must be installed and operated in a way that complies with local law and does not obstruct the driver's view, controls, instruments, mirrors, airbags, ventilation, or safe operation of the vehicle.
Customers must not adjust, view, or operate a product in a way that distracts from driving or other safety-sensitive activity.
Adhesive, suction, magnetic, clip-on, or other mounting methods may perform differently depending on the surface, temperature, vibration, cleanliness, shape, and installation technique. Customers are responsible for checking mounting security before use.
Outdoor, water-resistant, waterproof, dust-resistant, impact-resistant, or temperature ratings apply only where expressly stated and only under the stated conditions. Resistance may decrease because of wear, impact, bending, contamination, incorrect installation, damage, or age.
Customers must follow all cleaning, storage, maintenance, lens-care, electrical-safety, and operating instructions applicable to the product.
17. INTELLECTUAL PROPERTY
The website and its original content, including text, layout, branding, graphics, product photography, videos, logos, design elements, and software, are owned by or licensed to Vibneo and are protected by applicable intellectual-property laws.
No material may be reproduced, distributed, republished, modified, sold, or commercially exploited without prior written permission.
Third-party names, trademarks, service marks, product names, platforms, and logos belong to their respective owners. References to third-party products or services describe compatibility or functionality and do not imply ownership, sponsorship, or endorsement unless expressly stated.
18. THIRD-PARTY TOOLS AND LINKS
The website may provide access to tools, applications, payment services, maps, finding services, social platforms, or websites operated by third parties.
Vibneo does not control those services and does not guarantee their availability, accuracy, security, content, performance, or continued operation. Use of third-party services is at the customer's own risk and is subject to the applicable third party's terms and privacy policy.
19. REVIEWS, COMMENTS, AND SUBMISSIONS
When customers submit reviews, feedback, photographs, videos, suggestions, or other content, they confirm that they have the right to submit the content, that it is accurate to the best of their knowledge, and that it does not violate another person's rights or contain unlawful, defamatory, threatening, fraudulent, misleading, or malicious material.
Where permitted by law, the customer grants Vibneo a non-exclusive, worldwide, royalty-free license to use, reproduce, edit, translate, display, and distribute submitted content for business and marketing purposes. This does not transfer ownership of the customer's original content to Vibneo.
20. PROHIBITED USES
The website and products may not be used for unlawful purposes, fraud, misrepresentation, unauthorized surveillance or tracking, harassment, stalking, threats, abuse, violation of privacy or intellectual-property rights, collection of personal information without lawful authority, malware, scraping, interference with website security, circumvention of controls, unauthorized resale activity, unsafe operation, or any activity prohibited by applicable law.
We may suspend or terminate access where these Terms are violated.
21. PERSONAL INFORMATION
Collection and use of personal information are governed by our Privacy Policy and available Cookie Settings.
22. DISCLAIMER OF WARRANTIES
Nothing in this section excludes any warranty, guarantee, right, or remedy that cannot lawfully be excluded.
To the fullest extent permitted by applicable law, the website is provided on an "as available" basis. We do not guarantee uninterrupted or error-free website operation, continuous availability of third-party services, compatibility with every device or vehicle, a particular level of performance in every environment, or that a convenience product will prevent loss, damage, delay, distraction, or another unwanted outcome.
Product-specific warranties are limited to those expressly stated in the applicable policy or required by law.
23. LIMITATION OF LIABILITY
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
To the fullest extent permitted by law, Vibneo will not be liable for indirect, incidental, special, punitive, or consequential losses arising from website use, product use or misuse, improper installation, delayed delivery, loss of an item, device or vehicle incompatibility, third-party service interruption, performance differences, property damage caused by unauthorized or incorrect use, or circumstances outside Vibneo's reasonable control.
Any limitation applies only to the extent permitted by applicable law. Nothing in these Terms limits mandatory consumer rights.
24. INDEMNIFICATION
To the extent permitted by law, users agree to indemnify and hold Vibneo and its service providers harmless from claims, losses, liabilities, and reasonable costs arising from a material breach of these Terms, unlawful or unsafe use of the website or products, violation of another person's rights, unauthorized surveillance or tracking, fraudulent activity, or improper installation or modification.
This section does not apply where prohibited by applicable consumer law.
25. SEVERABILITY
If any provision of these Terms is found invalid or unenforceable, that provision will be enforced to the maximum lawful extent or removed where necessary. The remaining provisions will continue in effect.
26. NO WAIVER
A failure by Vibneo to enforce a provision on one occasion does not waive the right to enforce that provision or another provision later.
27. TERMINATION
These Terms remain effective until terminated. Customers may stop using the website at any time.
We may suspend or terminate access where a user materially violates these Terms, uses the Service unlawfully or unsafely, threatens website security, or abuses Vibneo, its customers, or its service providers. Termination does not affect obligations or rights that arose before termination.
28. GOVERNING LAW
These Terms are governed by and interpreted in accordance with the laws of Hong Kong, without regard to conflict-of-law principles.
However, this governing-law provision does not deprive a consumer of any mandatory protection available under the laws of the consumer's country or region of residence where those protections legally apply.
29. CHANGES TO THESE TERMS
We may update these Terms to reflect changes in products, services, policies, business practices, or legal requirements. Updated Terms will be posted on this page with a revised "Last updated" date. Where required by applicable law, additional notice will be provided.
